Why re-establish the boundaries of his property?

Re-establishment consists of verifying and establishing the boundaries of 2 adjoining private properties, using boundary stones, stakes or stones, in their original locations. This only concerns registered properties. This operation is carried out by a Topographical Surveyor registered with theONIGT. There are 2 main reasons for re-establishing the boundary markers on your property.

If you own a registered lot, but the boundaries are not clear on the ground, the recovery will allow you to know the limits of your property. The house you build must not encroach on the neighboring property. If your neighbor notices that you are encroaching on his land, he can demand that you demolish your building or remove your installation.

In the absence of precise re-establishment, it's difficult to know where your neighbor's land ends. Your neighbor may then unwittingly use part of your land, without any intention of harming you. However, your neighbor can legally become the owner of this piece of land without any reaction on your part after several years of use or exploitation.

There is no obligation to re-establish boundary markers. If, on the other hand, the bollards have disappeared over time or have been moved, they must be re-established before any construction or development work can begin. How do you go about restoring terminals?

During a preliminary meeting with a Geometrical Surveyor, which can take place in the field in order to explain your project, the Geometrical Surveyor will draw up a detailed fee proposal covering all his services.

Once the cadastral data documents have been researched (calculation of land area, cadastral plan, file of neighbouring titles, ....), the surveyor can set a date for a field mission. During this mission, it is advisable to be present. He will set up temporary markers (stakes) or permanent markers (milestones), according to your needs. The Topographical Surveyor will draw up a certificate which will be submitted to you at the end of his mission.

The cost of a reinstatement operation does not depend on the number of bollards to be installed, but on the configuration of the site, congestion, existing documents, the number of residents...

A number of other factors can also have an impact on the amount of the fee:

  • surveyor's fees: this professional sets his rates according to a fee guide;
  • travel expenses, if the latter is located far from the plot to be marked out;
  • the size of the plot: the larger the plot, the longer the time spent on it. On the other hand, a large plot also means more bollards to lay;
  • the complexity of the operation: it may be complicated by a sloping site or a lack of documentation, which also lengthens the operation and therefore its cost.

We strongly recommend that you re-establish the boundaries of a building plot or farmland before buying or selling, to avoid any subsequent disputes. Even if it's not compulsory, in practice it's always a good idea to re-establish boundary lines when selling real estate. In fact, it is often not required by the notary.

If a property is sold without the boundary lines being re-established, the buyer may be in for a surprise later on, especially in the case of encroachments that can only be detected during the re-establishment operation.
